Please read these terms and conditions carefully before using our services. By engaging with Kugie IT Consulting Studio, you agree to be bound by these terms.

1. Acceptance of Terms
By accessing and using the services provided by Kugie IT Consulting Studio (“Kugie,” “we,” “us,” or “our”), you (“Client,” “you,” or “your”) accept and agree to be bound by the terms and provisions of this agreement.
Business Entity Clarification: “Kugie” is the brand name under which we operate. In Indonesia, we are legally registered and operate under the business entity “CV. Palayu Mandiri.” All legal obligations, rights, and responsibilities outlined in these terms are held by CV. Palayu Mandiri.
If you do not agree to abide by the above, please do not use this service. We reserve the right to modify these terms at any time, and such modifications shall be effective immediately upon posting.
2. Service Description
Kugie provides IT consulting services including but not limited to:
- Web and mobile application development
- Custom software development
- Analytics dashboard solutions
- Content management systems
- Database creation and management
- Digital transformation consulting
- Technical support and maintenance
All services are provided in accordance with industry best practices and applicable Indonesian laws and regulations.
3. Client Responsibilities
As a client, you agree to:
- Provide accurate and complete information necessary for project completion
- Respond to requests for information in a timely manner
- Make payments according to the agreed schedule
- Provide access to necessary systems, accounts, and resources
- Review and approve deliverables within the specified timeframe
- Respect intellectual property rights and licensing agreements
- Use our services in compliance with all applicable laws
4. Payment Terms
Payment terms are as follows:
- All prices are quoted in Indonesian Rupiah (IDR) unless otherwise specified
- Payment schedules will be outlined in individual project agreements
- Late payments may incur additional charges as specified in the project agreement
- Refunds are subject to the specific terms outlined in individual contracts
- All taxes and fees are the responsibility of the client unless otherwise agreed
5. Intellectual Property
Unless otherwise specified in writing:
- Custom-developed solutions become the property of the client upon full payment
- Kugie retains ownership of proprietary methodologies, frameworks, and tools
- Third-party software and licenses remain the property of their respective owners
- Kugie may use generic knowledge and experience gained for future projects
- Clients grant permission to use project details as case studies unless confidentiality is requested
6. Confidentiality
We respect the confidentiality of client information. Kugie agrees to:
- Maintain strict confidentiality of client data and business information
- Implement appropriate security measures to protect sensitive information
- Not disclose confidential information to third parties without written consent
- Use client information only for the purpose of providing agreed services
- Return or destroy confidential information upon project completion or termination
7. Limitation of Liability
To the maximum extent permitted by law:
- Kugie’s liability is limited to the total amount paid for the specific service
- We are not liable for indirect, incidental, or consequential damages
- Client data backup and security remain the client’s responsibility
- Third-party service interruptions are beyond our control and liability
- Force majeure events excuse performance delays or failures
8. Termination
Either party may terminate the agreement:
- With written notice as specified in the project agreement
- Immediately for material breach of contract
- For non-payment of fees beyond agreed terms
- Upon completion of all agreed deliverables
Upon termination, all outstanding payments become due immediately, and each party retains their respective rights to intellectual property as specified herein.
9. Governing Law
These terms and conditions are governed by and construed in accordance with the laws of the Republic of Indonesia. Any disputes arising from these terms or our services shall be subject to the exclusive jurisdiction of the Indonesian courts.
10. Warranties and Disclaimers
Kugie provides services on an “as is” basis. While we strive for excellence:
- We do not guarantee uninterrupted or error-free service
- Third-party integrations may be subject to their own terms and limitations
- Technology solutions may require ongoing maintenance and updates
- Performance may vary based on external factors beyond our control
11. Support and Maintenance
Support and maintenance services are provided according to the specific terms outlined in each project agreement. Standard support hours are Monday through Friday, 9:00 AM to 6:00 PM WIB, excluding Indonesian public holidays.
